Terms of Service

Last updated: April 2, 2026

These Terms of Service ("Terms") govern your access to and use of Eternal After Life(the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Eternal After Lifeprovides tools to store legacy messages, heartbeat check-ins, occasion envelopes, and related features. The Service is provided on an "as is" and "as available" basis. We may change, suspend, or discontinue features at any time.

2. Eligibility

You must be at least 18 years old (or the age of majority where you live) to use the Service. You represent that the information you provide is accurate and that you have authority to bind any organization you represent.

3. Your account

You are responsible for safeguarding your credentials and for all activity under your account. Notify us at support@eternal-afterlife.com if you suspect unauthorized access.

4. Your content

You retain ownership of content you submit. You grant us a limited license to host, process, transmit, and display that content solely to operate and improve the Service (including automated release flows you configure).

You are solely responsible for the legality and appropriateness of your content and for obtaining any rights needed for media URLs or files you link or upload. Do not use the Service for unlawful, harassing, or infringing material.

If you upload a voice recording for an occasion letter, you confirm you have the rights and, where applicable, consent to store and play that recording for recipients you designate through the Service.

If you use Google Drive integration, you authorize us to read files you select for import and to create export folders and files in your Google Drive as described in the feature. You remain responsible for content you import and for complying with Google's terms.

5. Loved ones and recipients

By providing names and contact details of others, you represent that you have a lawful basis to share that information with us for the purpose of the Service (for example, consent or legitimate interest). You are responsible for how you describe the Service to recipients.

6. Subscriptions and fees

Some features may be offered under paid plans. Unless otherwise stated at checkout, fees and billing terms will be presented when payment processing is enabled. Until then, promotional or manual plan selection in the app does not constitute a completed payment contract.

7. Prohibited conduct

You agree not to:

  • Violate law or third-party rights.
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems.
  • Use the Service to distribute malware, spam, or deceptive content.
  • Reverse engineer or scrape the Service except as allowed by law.
  • Use the Service in any way that could harm, disable, or overload our infrastructure.

8. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT DATA WILL NEVER BE LOST. LEGACY AND RELEASE FEATURES ARE COMPLEX; YOU ARE RESPONSIBLE FOR VERIFYING THAT YOUR CONFIGURATION MATCHES YOUR INTENT.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100), IF YOU PAID NOTHING.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent allowed by law.

10. Indemnity

You will defend and indemnify us against claims arising from your content, your violation of these Terms, or your violation of others' rights, to the extent permitted by law.

11. Termination

We may suspend or terminate access if you breach these Terms or if we need to protect the Service or others. You may stop using the Service at any time. Provisions that by their nature should survive will survive termination.

12. Governing law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law rules, except where prohibited by your local law. Courts in Delaware shall have exclusive jurisdiction, subject to mandatory consumer protections in your country of residence. Operators may need a different venue or law—have counsel adapt this section.

13. Changes

We may modify these Terms. We will update the date above. Material changes may be announced through the Service or email where appropriate. Continued use after changes constitutes acceptance.
